Record settlement awarded in California drowning death

The parents of a young drowning victim received $16.3 million from the state of California.

The jury in a civil trial over the drowning of a four-year-old boy in Santa Barbara county Calif., recently awarded $16.3 million to the boy's parents. The verdict represents the highest drowning damages in the county, possibly even the state. It includes $2.3 million in punitive damages and $14 million in compensatory damages.

In 2005, the young boy drowned in the swimming pool at a local summer camp, which was not licenced. His parents sued the club that operated the camp, its management company and several club managers.

The jury found the camp managers and aquatics director guilty of wilful misconduct; the management company was found guilty of negligence and ordered to pay 15 per cent of the compensatory damages.

In a surveillance video shown during the trial, the boy can be seen struggling before slipping beneath the water, where he remained for eight minutes before being noticed.
