The federal Competition Bureau is taking action against two Alberta hot tub retailers and their directors for allegedly telling customers their products were qualified under the Energy Star program. The bureau alleges that, as early as 2007, businesses operating as EcoSmart Spas and Dynasty Spas made several claims in the sale and promotion of hot tubs, which created a false impression the products qualified for tax credits under the program. In filing the application with the Competition Tribunal, the bureau plans to get an order for the companies to cease the alleged conduct, issue corrective notices and pay fines. "Consumers rightly expect to receive truthful and accurate information so they can make informed purchasing decisions," says bureau commissioner, Melanie Aitken. "In filing this application, the bureau is sending a strong message to those who mislead consumers about the energy efficiency of their products." The Competition Bureau is an independent law enforcement agency that protects and promotes competitive markets, enabling consumers to make informed decisions. Over the last year, it has entered into nine consent agreements with other hot tub retailers who had been making similar representations about Dynasty Spas products.
