Terms and Conditions

The Pool & Spa Marketing/Pools, Spas & Patios Awards of Excellence (property of Kenilworth Media Inc.) were created to recognize and celebrate the industry’s commitment to excellence, customer service, environmental stewardship and the uniqueness of Canadian pool and backyard design. In addition they will showcase industry craftsmanship to Canadian homeowners, as well as educating and demonstrating the significance of pool/spa ownership and how the backyard space can be utilized to enhance the value of a property and the overall enjoyment of outdoor leisure living.

Who can enter the competition?

Top Pool/Hot Tub Builder

  • Must have built/installed a pool or hot tub within the last 18 months.
  • Must be a registered company, residing in the Canadian province of entry.

Top Service Pro

  • Must have provided basic pool services (openings, closings, cleaning, chemical maintenance) within the last 18 months.
  • Must be a registered company, residing in the Canadian province of entry.

The Sustainability Award

  • Open to pool/hot tub builders, pool/hot tub service professionals and landscape professionals who have demonstrated a commitment to environmental excellence through projects and/or processes.
  • Must be a registered company, residing in the Canadian province of entry.

Ultimate Backyard

  • Project must have been completed in Canada in the last 18 months, and contain unique elements that tie the entire backyard into one cohesive outdoor living space.
  • Must be a registered company.

Entry fees and deadline

  • Initial entry (any category) is $49.00 (plus applicable taxes).
  • Additional entries are $25.00 (plus applicable taxes) per entry.
  • Entries will be accepted between October 15, 2016 at 12:00 a.m. and February 28, 2017 at 11:59 p.m.

How to enter

  • Entries can be submitted via our online award portal found at https://order.kenilworth.com/portal/awards .
  • Payment information will be required in order to enter the submissions in the competition (amounts payable will be based on the number of entries submitted and calculated at the time of entry).
  • Entry limits are based on category as follows:
    • Top Pool/Hot Tub Builder – limit of one entry per company.
    • Top Service Pro – limit of one entry per company.
    • The Sustainability Award – limit of one entry per company.
    • Ultimate Backyard – unlimited entries per company.

Eligibility

In addition to the criteria found under ‘Who can enter the competition?’, all entries must conform with the following:

  • Any photos submitted must not show any people, pets or alcoholic beverages. No names, addresses or copyrights may appear on the photographs.
  • Any projects and/or processes submitted in whole, or as part of an, entry must be in compliance to all building and installation codes and regulations as deemed by the Industry standards and North American laws.
  • All appropriate and necessary permissions have been secured from the homeowner in the case of projects submitted, particularly as it pertains to the use of photos of said projects.

Judging

  • The Awards Committee will select a panel of judges who will assign merit points on a variety of criteria when making their selections, including the following:
    • Awards received from other associations/groups
    • Participation in the industry (includes industry affiliations and industry education)
    • Authenticity (e.g. licenses in good standing)
    • Good business practices
    • Project/process features (uniqueness, creativity, design, complexity, technical advances)
  • Entries are anonymous to the judges.
  • Highest total scores will determine the order of finish.
  • At the judges’ discretion, any number of medal and merit awards may be granted in a category.
  • Judges do not have to recognize any category if they deem that no entries merit an award.
  • Decisions of judges are final.

Award recognition

  • Award winners will be announced in the 2017 issue of Pools, Spas & Patios and the June 2017 issue of Pool & Spa Marketing, as well as on poolspas.ca, in the Waterlines newsletter and via various social media channels.

Publicity and disclaimer

  • Award winning photos may be featured in Pools, Spas & Patios and Pool & Spa Marketing magazines, on poolspas.ca , in the Waterlines newsletter, via various social media channels and in additional promotional materials to both the industry and consumers.
  • It is understood that the photos submitted in this competition may be used for publication and other forms of advertising and promotional materials as deemed appropriate by Kenilworth Media Inc.
  • It is understood that Kenilworth Media Inc. makes no affirmation or certification with respect to legitimacy of company, design, soundness or safety of any entries.
  • This competition is subject to all applicable federal, provincial and municipal laws and regulations. Void where prohibited. All entries become the property of Kenilworth Media Inc and none will be returned. Kenilworth Media Inc. reserves the right to withdraw, terminate or modify this competition or any portion of this competition, or extend the deadline of this competition, at any time without prior notice. Kenilworth Media Inc. does not assume any responsibility for lost, delayed or misdirected entries, or for technical difficulties of any kind resulting in the inability of a user to enter the competition. Kenilworth Media Inc. will use the personal information you provide on the entry form to administer the competition, and to contact you if you are selected as a winner.
  • Kenilworth Media Inc. does not assume any responsibility for failure of the internet or the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion. Kenilworth reserves the right, in their discretion, to cancel, modify or suspend this Contest, or any portion thereof, at any time and without notice or obligation if, in Kenilworth’s opinion, any factor interferes with its proper conduct as contemplated by these competition rules, including but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, programming errors, or technical failures, or other cause beyond their reasonable control, which, in the opinion of Kenilworth Media Inc., corrupt or affect the proper administration security, fairness, integrity or proper conduct of the competition. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws. Should such an attempt be made, Kenilworth Media Inc and the Sponsor(s) reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

Limitation of Liability

In no event will Kenilworth Media Inc. and/or their related companies, directors, employees, representative or agents be liable for any direct, indirect, consequential, exemplary, incidental, special or punitive damages, including any lost income or lost data or damage to any computer system, arising from your participation in the competition, or errors or omissions contained therein, even if we are aware or have been advised of the possibility of such damages.
